Exemption letter – is a document explaining that a certain kind of a product is not subject to obligatory certification or declaration.
Exemption letters are issued by the state authorities and organizations authorized by the Federal Agency for Technical Regulation and Metrology. There are two kinds of exemption letter:

  • Exemption letter for custom;

  • Exemption letter for trade.

Nowadays exemption letters are issued by the Ministry of Industry and Trade of the Russian Federation (Minpromtorg) and All-Russian Research Institute for Certification (VNIIS).
Exemption letter of VNIIS is issued on the basis of the Letter ¹ CP-101-26/5511 dated November 14, 2007, in accordance with the Resolution of the Government of the Russian Federation ¹ 982 dated December 1, 2009;
Exemption letter of Minpromtorg is issued on the basis of the Letter to Federal Custom Service ¹ 319 dated June 18, 2010 and Resolution of the Government of the Russian Federation ¹ 982 dated December 1, 2009.
Exemption letters of VNIIS and Minpromtorg are also issued to confirm compliance with the requirements of the current Technical Regulations.

The list of products subject to obligatory certification and declaration is regulated by:

  • The Resolution of Gosstandard of the Russian Federation (Federal Agency for Technical Regulation and Metrology of the Russian Federation) dated July 30, 2002, ¹ 64 “On nomenclature of products and services (works) subject to obligatory certification”.
  • The Resolution of Gosstandard of the Russian Federation (Federal Agency for Technical Regulation and Metrology of the Russian Federation) dated July 30, 2002, ¹ 64 “On nomenclature of products conformity of which can be proved by declaration od conformity”.
  • Technical regulations approved by the Federal Agency for Technical Regulation and Metrology of the Russian Federation.

If a product is not mentioned in any of the above stated documents, an exemption letter can be obtained for this product.

To obtain an exemption letter for custom you are to submit the following documents:

  1. Application for obtaining an exemption letter with signature, stamp and details of the company-applicant;
  2. Contract;
  3. Specification;
  4. Invoice;
  5. Detailed description of a product (technical characteristics, field of application, trade dress);
  6. TN VED code of a product;
  7. Power of attorney of the company-applicant granted for an individual authorized him\her to obtain an exemption letter.

To obtain an exemption letter for trade you are to submit the following documents:

  1. Application for obtaining an exemption letter with signature, stamp and details of the company-applicant;
  2. Detailed description of a product (technical characteristics, field of application, trade dress);
  3. OKP code of a product;
  4. Power of attorney of the company-applicant granted for an individual authorized him\her to obtain an exemption letter.
