Declaration of production compliance
Declaration of compliance is a document proving compliance of the declared goods with the corresponding quality and technical regulations standards.
According to article 24 of the Federal Law «Concerning Technical Regulation» ¹ 184 dated December 27, 2002, a declaration of compliance can be issued:
- For goods of domestic manufacturer (seller);
- For a representation of a foreign company or supplier (importer) of foreign goods which is officially registered in the Russian Federation.
List of goods subject to receiving a declaration of compliance is defined by Decree of the Federal Agency for Technical Regulation and Metrology of the Russian Federation dated July 30, 2002 ¹ 64 «Concerning product nomenclature the Compliance of which can be proved by declaration of compliance».
Getting a declaration of compliance
The process of getting a declaration of compliance does not differ much from certification and the only difference is forms:
- certificate of compliance is issued on a standard form,
- Issuing of a declaration of compliance does not imply a specific form (the manufacturer fills in the declaration of compliance himself and then registers it in an accredited certification authority).
Declaration of compliance and certificate of compliance have equal legal power and are registered by Certification Authorities. During registration, a declaration is assigned a registration number containing the Certification Authority code and order number.
It should be noted that the responsibility for the quality of the declared goods lies on the applicant.
Each declaration of compliance issued is registered in Unified Register of declarations of compliance of the Federal Agency for Technical Regulation and Metrology of the Russian Federation and gets an individual number assigned to it.
Documents necessary for issuing and registration of a declaration of compliance
Issuing of a declaration of compliance on goods of a domestic manufacturer:
- Application for issuing and registration of a declaration of compliance;
- A copy of State Registration Certificate of the company;
- Normative and technical documentation for the manufactured products;
- A copy of Certificate of registration with a tax authority;
- A copy of letter from Federal State Statistics Service;
- A copy of Statute of the company;
- A copy of State Registration Certificate of the products (if necessary);
- A copy of Sanitary-epidemiological conclusion certificate or Manufacturing permit of Federal Service for Consumer Rights and Human Welfare Protection;
- A copy of contract of lease of production space or a copy of a title deed;
- Copies of certificates of compliance for raw materials or copies of State Registration Certificates of the products;
- Source document of Certification test report or reports of the products to be declared;
- A copy of Trademark Certificate proving the right to use the given Trade Mark (if the applicant wants to indicate the products trade mark in the certificate).
Issuing of a declaration of compliance for goods of foreign manufacture:
- Application for issuing and registration of a declaration of compliance;
- A copy of State Registration Certificate of the company;
- A copy of Certificate of registration with a tax authority;
- A copy of State Registration Certificate of the products (if necessary);
- Copies of Certificates of quality or declarations of quality from product manufacturer. A copy of ISO certificate, if possible;
- Source document of Certification test report or reports of the products to be declared;
- A copy of contract or invoice;
- A copy of specification to the contract;
- Product description (composition, appearance, sphere of application) or safety data sheets for specific types of products.
The process of issuing of a declaration of compliance is defined by legislative act "Nomenclature of products subject to compulsory declaration", and in case of certificate of compliance the necessity is defined by "Nomenclature of products subject to compulsory certification".
Apart from declaration of compliance, product suppliers or manufacturers are also quite often asked for certificate of compliance (compulsory or voluntary), so it makes sense to get a voluntary certificate as well.
